A.1 Account Integrity, Access & Communication
- Onboarding Verification: Users must provide accurate corporate identities, business email addresses, and valid target volume data during signup. Accounts found utilizing false credentials or matching unauthorized business entities will be permanently terminated.
- Instant Communication Handling: Both parties acknowledge that primary account management, operational adjustments, and immediate campaign updates are conducted via live communication handles (such as Skype or Telegram IDs). You agree to maintain active, responsive access to these channels to prevent campaign pauses or settlement delays.
- Security: You are entirely responsible for protecting your account authentication details. MobAdvantage will not be liable for any unauthorized budget consumption, data changes, or loss resulting from passwords compromised outside our system.
A.2 Strict Anti-Fraud & Traffic Integrity Standards
- Zero-Tolerance Matrix: MobAdvantage uses an integrated pre-bid anti-fraud filtration shield to monitor real-time traffic behaviors, invalid clicks, and click-to-install time deltas.
- Prohibited Artificial Manipulations: The network strictly bars click farms, emulator traffic, SDK spoofing, hidden iframe layering, auto-refresh templates, and forced incentivized conversions masquerading as non-incentivized human user acquisition.
- Penalties: If our security protocol or third-party validation engines identify invalid or fraudulent traffic variations exceeding a threshold of 1%, MobAdvantage reserves the right to freeze campaigns immediately, forfeit outstanding publisher earnings, and issue refunds or credits to affected advertisers.
Part B
Specific Terms for Advertisers
Governing Buyers, Agencies, and Media Planners.
B.1 Performance-Tied Buying & Optimization
- Billing Framework Allocation: Advertisers can configure campaigns using multiple performance metrics, including CPA, CPI, CPC, CPL, CPM, CPR, CPE, or CTV Video completion parameters.
- Campaign Adjustments: Budget limits, geo-fencing requirements, device targeting parameters, and creative updates can be executed via your self-serve portal or requested directly through your designated Skype/Telegram account specialist. Budget caps and campaign pauses require up to a 12-hour technical buffer to fully stop across all global publisher nodes; the advertiser remains liable for clicks or conversions tracked within this brief buffer period.
B.2 Omnichannel Attribution & Budget Shifts
- Cross-Device Coordination: By deploying our programmatic cross-device identity graph, advertisers agree to our unified cross-attribution parameters. If an individual user journey jumps across multiple touchpoints (e.g., household Connected TV exposure leading to an on-device OEM smart folder notification and a final mobile web or app action), attribution will resolve to our combined system metric to eliminate duplicate or brokered billing claims.
- Dynamic Capital Scaling: Advertisers are permitted to shift active capital balances across Web, App, OEM, and CTV allocations seamlessly within the singular platform environment based on ongoing performance trends.
B.3 Financial & Deposit Frameworks
- Payment Terms: Unless granted an explicit line of credit verified by our corporate financial department, all media buying operates on a pre-funded deposit structure. Deposits can be issued through wire transfers, international online processors, or approved local banking tools.
- Matching Incentives: Any promotional match credits (e.g., “Fund $500, get $150 in test traffic credits”) are strictly non-refundable, non-withdrawable, and must be consumed entirely on active ad impressions through the MobAdvantage ecosystem within 90 days of issue.
Part C
Specific Terms for Publishers
Governing App Developers, Webmasters, and Inventory Suppliers.
C.1 Onboarding Criteria & Traffic Quality
- Premium Traffic Thresholds: To ensure compliance with premium global demand guidelines, MobAdvantage focuses heavily on properties maintaining high engagement scales, prioritizing publishers matching a minimum footprint of 1 Million Daily Active Users (DAU) and 30 Million Monthly Active Users (MAU).
- Creative Content Restrictions: Publishers must not implement our lightweight SDK or asynchronous web tags on properties that showcase adult content, hate speech, violent media, intellectual property violations, or malicious software scripts.
C.2 Inventory Valuation & Cost Segmentation
- Multi-Segment Isolation: Publishers agree to our structural segment monetization protocol. Each segment of an application or web domain's inventory (e.g., full-canvas Rewarded Video slots vs. context native feed blocks or specific regional geolocations) is calculated and auctioned as an independent tier. MobAdvantage does not issue flat network averages; payouts match the exact dynamic programmatic real-time competitive bids won by each isolated placement.
- 100% Fill Rate Commitment: While the system maximizes direct demand loops, the publisher authorizes MobAdvantage to route unfilled international inventory chunks into automated programmatic RTB backfill channels to protect monetization yield.
C.3 Flexible Accelerated Payout Schedules
- Settlement Terms: To minimize cash flow friction for developers, MobAdvantage moves past legacy Net-60 models. Publishers can select standard Net-30, accelerated Net-15, or conditional Weekly Payout Thresholds, subject to account validation and minimum earnings parameters.
- Payment Methods: Disbursements are processed via bank wire, digital wallets, or regional corporate clearing systems. The publisher is solely responsible for processing fees or localized tax liabilities arising from received ad revenue.
Part D
Indemnification & Limitation of Liability
Applicable to all parties on the network.
D.1 Mutual Indemnification
Each party agrees to indemnify, defend, and hold harmless the other party and its corporate officers, directors, and employees from any direct liabilities, legal damages, losses, or expenses resulting from a proven breach of intellectual property rights, data privacy regulations, or systemic distribution of illegal materials.
D.2 Limitation of Platform Liability
MobAdvantage provides its omnichannel software architecture, SDK structures, and automated matching algorithms on an “as-is” and “as available” basis. Except as explicitly stated in this text, the Company makes no warranties regarding continuous platform uptime, zero latency variations, or specific conversion volumes.
Liability Cap. In no scenario shall MobAdvantage be liable for any indirect, incidental, or consequential revenue deficits or data drops, with our maximum liability limited to the total net platform fees collected from your specific account during the three (3) months immediately preceding the event giving rise to a claim.
D.3 Governing Law & Dispute Resolution
These Terms & Conditions are governed by and construed in accordance with standard international ad-tech commercial laws. Any structural discrepancies or contractual arguments that cannot be settled via fast-track consultations over Skype/Telegram will be submitted to confidential, binding arbitration before an authorized regional commercial arbitration panel.
